Welcome to C-UGC.site ("C-UGC," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of our AI-powered short-form UGC video generation platform, including our website, API, and all related services (collectively, the "Services").

By accessing or using C-UGC.site, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Service Description

C-UGC provides an AI-powered platform for generating short-form user-generated content (UGC) videos from text input. Our Services include:

• Web-based video generation interface
• Access to multiple AI model creators
• Free API for programmatic video generation
• Token-based usage system
• Video output download capabilities

2. Anonymous Access & User Identification

C-UGC operates without traditional user authentication. We do not require registration, login credentials, or personal accounts. Instead:

• A unique anonymous identifier is automatically generated and stored locally in your browser's localStorage
• This identifier is used solely to track your token balance and service usage
• You remain completely anonymous - we do not collect or store personal identification information
• Clearing your browser data will remove this identifier and you will receive a new one upon your next visit

Important: If you clear your browser's localStorage, you will lose access to any remaining token balance associated with your previous identifier. We cannot recover or transfer tokens between identifiers.

3. Token System & Payment Terms

3.1 Token Usage

Video generation on C-UGC requires tokens. Each video generation request consumes a certain number of tokens based on the selected AI model and video parameters.

3.2 Token Purchase

• Tokens are purchased through our Stripe payment integration
• All token purchases are final and non-refundable except as required by law
• Token prices are displayed in USD and may be subject to change with notice
• Purchased tokens do not expire but are tied to your browser's unique identifier

3.3 Payment Processing

All payments are processed securely through Stripe. We do not store your payment card information. By making a purchase, you agree to Stripe's terms of service and privacy policy.

4. Acceptable Use Policy

You agree to use C-UGC Services only for lawful purposes. You must not:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Create content that infringes on intellectual property rights, privacy rights, or any other rights of third parties
• Generate content depicting minors in any inappropriate context
• Create deepfakes or misleading content intended to deceive or defraud
• Use the Services to impersonate real individuals without their explicit consent
• Generate spam, malware, or content for phishing or other malicious purposes
• Attempt to reverse engineer, decompile, or extract the underlying AI models
• Abuse the API or attempt to circumvent rate limits or token requirements
• Resell or redistribute generated videos as a competing service without authorization

We reserve the right to suspend or terminate access to any user violating these terms, with or without notice.

5. Content Rights & Intellectual Property

5.1 Your Content

You retain ownership of the text input ("Input") you provide to generate videos. By using our Services, you grant C-UGC a limited license to process your Input for the purpose of generating video output.

5.2 Generated Videos

Subject to these Terms and payment of applicable fees, you receive a license to use the generated video content ("Output") for your personal or commercial purposes. However:

• The AI models and underlying technology remain the property of C-UGC and its licensors
• You are responsible for ensuring your use of Output complies with all applicable laws
• You must not claim the Output was created by a real person if it depicts an AI-generated persona
• We reserve the right to use anonymized data for improving our Services

5.3 Platform Rights

All rights, title, and interest in the C-UGC platform, including our website, API, trademarks, logos, and proprietary technology, remain the exclusive property of C-UGC.

6. API Usage Terms

• Our API is provided for free with rate limitations
• API access requires the same token consumption as web-based usage
• We may impose rate limits, throttling, or other usage restrictions to maintain service quality
• API terms may be subject to change with reasonable notice
• Abuse of API access may result in permanent restriction

7. Privacy & Data Handling

Your privacy is important to us. Our privacy practices are detailed in our Privacy Policy. Key points include:

• We do not use cookies for tracking or advertising
• We do not collect personal identification information
• Anonymous usage data may be collected to improve Services
• Payment processing is handled securely through Stripe

8. Disclaimers of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied.

C-UGC does not guarantee that:

• The Services will be uninterrupted, secure, or error-free
• Generated videos will meet your specific requirements or expectations
• AI-generated content will be free from defects, inaccuracies, or artifacts
• The Services will be available at all times or in all geographic locations

9. Limitation of Liability

To the maximum extent permitted by law, C-UGC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

Our total liability for any claims related to the Services shall not exceed the amount you paid to C-UGC in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless C-UGC from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use or misuse of generated video content
• Your infringement of any third-party rights
• Any illegal or unauthorized use of the Services

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on this page with an updated effective date. Your continued use of the Services after changes constitutes acceptance of the modified Terms.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services will immediately cease, and any unused tokens will be forfeited without refund.

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the jurisdiction where C-UGC operates, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration or in the courts of competent jurisdiction.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and C-UGC regarding the Services.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
